Estate and Business Planning Packages

1. Basic Wills Package

This package is suitable for persons who have “simple affairs” ie only have assets in their own name and superannuation in an industry superannuation fund.

Not suitable for clients who:

  1. Have a Self Managed Superannuation Fund, Family Trust or a Business owned with a third party
  2. Are looking to exclude a beneficiary from their Will or who will otherwise have Testator Family Maintenance (TFM) Claim issues
  3. Have a blended family
  4. Otherwise need consideration of tax planning, asset protection and general estate planning matters.

Costs

  • Basic Will for a single person $350 plus GST – does not include estate planning advice.
  • Basic Wills for a married couple $700 plus GST
  • Power of Attorney – Financial – $150 plus GST (if by itself)
  • Power of Attorney – Medical Treatment – $100 plus GST (if by itself)
  • Power of Attorney – Enduring Guardianship (lifestyle Power of Attorney) – $100 plus GST (if by itself)
  • Basic Recommended Will Package
    • Single Person Will, Financial and Medical Power of Attorney – $550 plus GST
    • Married Couple Wills, Financial and Medical Power of Attorney – $990 plus GST

2. Medium Level Estate Planning Package

This package is suitable for clients who want a “Basic Will” but whose affairs require additional consideration on such matters as:

  1. Assets held in Family Trusts or Self Managed Superannuation Fund
  2. Superannuation nominations
  3. Assets owned jointly with others
  4. Blended Families with children from previous relationships
  5. Estate Planning structuring to avoid TFM claims
  6. Asset protection and tax planning (CGT, land tax, duty)

Costs

  • Fees for basic Estate Planning will apply for drawing Wills and Powers of Attorney with additional fees as set out below
  • Fees will be charged on an hourly rate for specialist Estate Planning advice at the rate of $350 per hour plus GST. The hours spent will ultimately depend on a client’s particular circumstances.

3. Advanced Estate Planning Package

This is suitable for clients who:

  1. Are high net wealth clients (clients who have in excess of $1m in estate assets)
  2. Have multiple structures such as Family Trusts, SMSF’s, life insurance, Business Agreements (Buy/Sell and Shareholder/Unit holder Agreements)
  3. Want to include clauses that protect Beneficiaries – ie disabled beneficiaries, gambling/alcoholic beneficiaries
  4. Want to incorporate testamentary trust clauses within their Wills

Costs

  • A Will incorporating a basic testamentary trust $900 plus GST
  • A Will incorporating more advanced testamentary trusts including provision for:
    • Drip feed capital distribution clauses
    • Protective trusts for disabled beneficiaries, gamblers, alcoholics etc
    • Control of Family Trusts, Superannuation Nominations (in Industry or SMSF), life insurance
  • Costs starting from $1,200 plus GST for each testamentary trust.
  • Fees will be charged on an hourly rate for specialist Estate Planning advice at the rate of $350 per hour plus GST. The hours spent will ultimately depend on a client’s particular circumstances.
  • Power of Attorney – Financial – $150 plus GST (if by itself)
  • Power of Attorney – Medical Treatment – $100 plus GST (if by itself)
  • Power of Attorney – Enduring Guardianship (lifestyle Power of Attorney) – $100 plus GST (if by itself)
  • Company Powers of Attorney $300 (a personal power of attorney does not permit to person to act as a director/trustee – separate documentation is required)

Indicative Prices

The above prices quoted are indicative prices only. Fees incurred may be more or less depending on the individual circumstances of the client.

We are more than happy to attend the client at their home or hospital (particularly for older clients where a Will is urgently required) but an additional fee of $150 plus GST will apply. (Note in this respect we do not charge our travelling time as some lawyers do.)
